Terms and Conditions

By placing an order for a roll off dumpster from Budget Bins, Inc. ("Budget Bins"), you ("Customer") agree to:

Charges and Payment - Customer shall pay Budget Bins Inc for the collection and disposal of waste material. Customer agrees to pay charges agreed upon prior to initial delivery of the roll off by credit card. The same credit card information will be retained by Budget Bins to cover any additional charges.  Additional charges may include but are not limited to any hand or machine removal of unacceptable materials, blocked containers, cancellation fee, trip charges for being unable to perform scheduled work and relocation fee due to no fault of the Hauler. Each of the above fees will be charged to the credit card on file promptly after service is provided.  In the event that any payment is not made when due, Budget Bins may terminate services, recover all past due payments and recover any equipment from the Customer. Budget Bins reserves the right to charge a fee no greater than that allowed by law on all Customer payments returned for any reason.

Broker - Budget Bins is a broker. Budget Bins will endeavor to hire a hauler to deliver and remove the dumpster as requested by the customer. Customer agrees to release, defend, and hold harmless Budget Bins Inc from all liability that Budget Bins Inc may have for the negligence of Budget Bins and the hauler.

Wait Fees - Customer agrees to pay for any extended (over 20 minutes) wait times due to the following:  blocked dumpster or delivery area, overloaded container, customer late for arrival, access to property (gates, etc.), any other wait times due to no fault of the Budget Bins Inc or their contracted Hauler. Customer agrees to pay $4.00 per minute after the allotted 20-minute grace period.

Right of Way - Customer hereby warrants that any right of way provided by customer for the waste hauler's equipment is sufficient to bear the weight of all equipment and vehicles reasonably required to perform the service herein contracted. Budget Bins and their contracted Hauler will not be responsible for damage to any private driving surface, pavement or accompanying sub-surface of any route reasonably necessary to perform service herein contracted and customer assumes all liabilities for damage to driving surfaces, pavement, yard, or road surfaces and entire container placement site. Customer agrees that Budget Bins and their contracted Hauler is not responsible for damage to lawns, yards or any other grass surface where dumpster is being dropped.

Disclaimer- Customer agrees that Budget Bins Inc and their contracted Hauler is not responsible for any damage to driveways, curbs, walks, wells, and septic systems. Customer is responsible for notifying Budget Bins of any underground utilities which might be affected by taking delivery of the dumpster. Customer is responsible for calling 811 Miss Utility prior to delivery of the container if there is any doubt to the location of underground utilities.

Delivery and Pick Up - Delivery and / or removal of the dumpster is at the discretion of Budget Bins Inc and their contracted Hauler. If the driver is unable to deliver or pick up a dumpster due to safety, inaccessibility, overweight container or overloaded container, the Customer shall pay a trip charge of up to $250.

Overloaded Containers - Customer agrees to not fill roll off dumpster above top rails. Not only is it illegal to transport an overloaded dumpster, it is extremely dangerous. Budget Bins Inc and their contracted haulers reserve the right to refuse pick up of any overloaded dumpster and Customer is responsible for any additional fees that may be uncured due to the inability to provide the scheduled service. If your dumpster goes over the allotted tonnage, you are responsible for an overage fee of $72/ton over the allotted tonnage.

Equipment Care -  The equipment furnished by Budget Bins' contracted hauler shall remain the property of said Hauler. Customer does agree that it has care, custody and control of the Hauler's dumpster while at the Customer's location and accepts responsibility for any loss or damage to the equipment (except damage resulting from Hauler's driver negligence). Customer agrees not to overload, move or alter the equipment, and shall use the equipment only for its proper and intended purpose. Customer agrees to indemnify, defend and hold harmless both Budget Bins and their contracted Hauler against all claims, damages, suits, penalties, fines and liabilities or injury or death to person or loss or damage to property arising out of Customer's use, operation or possession of the equipment, including allegations of Budget Bins Inc or their contracted Hauler's negligence.

Waste Material and Contamination - Customer represent and warrants that the materials placed in Budget Bins Inc and their contracted Hauler's equipment shall be waste material as defined herein and shall contain no other substances. The term "waste material" as used in this agreement shall mean solid waste generated by Customer excluding radioactive, explosive, highly flammable, biomedical, infectious, toxic, or hazardous material. the term "hazardous material" shall include but not be limited to and amount of waste listed or characterized as hazardous by the United States Environmental Protection Agency. Title to and liability for any waste excluded above shall remain with Customer and Customer expressly agrees to defend, indemnify and hold harmless Budget Bins and their contracted Hauler from and against any and all damages, penalties, fines and liabilities arising from waste excluded above, including allegations of Budget Bins and their contracted Hauler's negligence. Customer agrees that there may be additional charges for the inclusion of any of the following  unacceptable materials in dumpster.

Unacceptable materials Include but are not limited to:

  • Hazardous Waste

  • Medical Waste

  • Chemical Products

  • Pesticides

  • Oil Filters

  • Motor Oil/Transmission Oil/Hydraulic Oil

  • Fuel

  • Industrial Waste

  • Solvents

  • Radioactive Material

  • Paint (wet in can)

  • Aerosol cans

  • Antifreeze

  • Tires ($50 per tire fee assessed if found in dumpster)

  • Batteries

  • Mattresses ($250 per mattress fee assessed if found in dumpster)

  • Computers and monitors

  • Televisions

  • Fluorescent bulbs and tubes

  • Railroad Ties

  • Animals

​

Cancellations - Cancellations made less than 24 hours prior to the scheduled service date will be subject to a cancellation fee of up to $250.

​

Attorney Fees - In the event of breach of the Agreement by the Customer, the Customer shall pay all reasonable attorney's fees and costs of Budget Bins to enforce this Agreement.
